1. Introduction

Thank you for choosing Getting Married in Denmark.

Before engaging our services, it is important that you first carefully read, understand and agree to the Getting Married in Denmark ApS Terms of Service.

To ensure mutual understanding and respect for each other, these terms of service allow us to be clear about the legal obligations and responsibilities between us.

By agreeing, you are bound by these Terms of Service. Please contact us if you have any queries or concerns.

Definitions:

GMID - Getting Married in Denmark ApS

AFL - Agency of Family Law

Detailed Documents List - The email with the list of documents the AFL requires when one wishes to submit an application to get the approval to get married in Denmark

2. Payment Terms

Stripe

GMiD uses the 3rd party payment platform, Stripe, the Stripe API, and in conjunction, your Stripe account to process credit and debit card transactions.

By using the Stripe Check Out you agree to be bound by Stripe’s Terms of Service.

You expressly understand and agree that GMiD shall not be liable for any payments and monetary transactions that occur through your use of the Stripe Service.

You expressly understand and agree that all payments and monetary transactions are handled by Stripe. You agree that GMiD shall not be liable for any issues regarding financial and monetary transactions between you and any other party, including Stripe.

You are responsible for all transactions processed through Stripe. GMiD is not liable for loss or damage from errant or invalid transactions processed with your Stripe account. This includes transactions that were not processed due to a network communication error, or any other reason. If you process a transaction, it is your responsibility to verify that the transaction was successfully processed.

You understand that GMiD uses the Stripe API to run the Service and that the Stripe API is subject to change at any time and such changes may adversely affect the Service. You understand and agree to not hold GMiD liable for any adverse affects that actions (whether intentional or unintentional) on the part of Stripe may cause to your Stripe account, or your business.

You must not process stolen credit cards, or unauthorized credit cards through Stripe

GMiD does not have access to your payment details and as such GMiD is not able to update or change any type of information, such as but not limited to names and card details, that is added when making a payment through Stripe.

Transaction Security

All transaction information passed between GMiD and Stripe’s systems is encrypted using 256-bit SSL certificates. No cardholder information is ever passed unencrypted. You can be completely assured that nothing we pass to Stripe’s servers can be examined, used or modified by GMiD and/or any third parties attempting to gain access to sensitive information.

3. Cancellation Policy

Essential Service

With the Essential Service, it remains your responsibility to read the information given by the AFL on their website regarding fees and other procedures before payment or application.
We are not liable for any behaviour or delays that the AFL cause. The AFL reserves the right to request extra documentation and investigate at any time during the application.

If for any reason you decide to cancel our service after choosing our Essential Service, there can be no refund if GMiD has already sent you the Detailed Documents’ List.

With the Essential Service, GMiD does not pay nor are we liable for the administration fee for the AFL.You pay the fee directly to the AFL. The administrative fee is non-refundable, including when you decide to discontinue your case, decide not to get married during the approval period given to you and/or if the AFL decides to close or reject your case.

We are not liable for any behaviour or delays that the AFL cause. The AFL reserves the right to request extra documentation and investigate at any time during the application.

We are not liable if the date that you would like is not available at the town hall of your choice. We work with a number of carefully selected town halls and will always strive to find a solution for you (which may require that you stay flexible with your preferred dates and location).

If for any reason you decide to cancel our service after choosing our Complete Service and after GMiD has sent the Detailed Documents’ List:
a. we refund €500 if we have not yet made your application (and paid the administrative fee on your behalf to the AFL);
b. there can be no refund if we have processed your application (and paid the administrative fee on your behalf to the AFL).

MayDay Service

We are not liable for any behaviour or delays that the AFL cause. The AFL reserves the right to request extra documentation and investigate at any time during the application.

We are not liable if the date that you would like is not available at the town hall of your choice. We work with a number of carefully selected town halls and will always strive to find a solution for you (which may require that you stay flexible with your preferred dates and location).

If for any reason you decide to cancel our service after choosing our MayDay Service, there can be no refund if GMiD has already sent you the Detailed Documents’ List.

Apostille service

A full definition of the Apostille Service can be found here.

Until six months after your wedding date, you can cancel this service before it is carried out and receive a full refund. Six months after your wedding date, we no longer refund, nor carry out the service.

Once the service has been or is being carried out, there can be no refund.

If you made available less certificates than you paid for, we either refund the fee for the additional certificate(s) or carry out the service after we have received all the certificates for which you paid the legalisation fee.

If you wish to receive the certificates to two or more different addresses, we charge a fee of EUR 70 for each additional address.

Town Hall Ceremonies

A town hall ceremony is short, lasting around 5 – 7 minutes. It will begin with the registrar saying a short speech about the importance of marriage, before they turn to each of you, the couple, to ask if you will legally marry the other. You can say your own short vows and exchange rings if you wish. The paperwork is then signed.

Your wedding ceremony is carried out by the Danish government. The local authorities are responsible for this day and this is a service that they (and not GMiD) provide to you.

The wedding ceremony at the town hall is therefore not part of our service, and the service fee you pay to us, does not cover any aspect of this.

For this reason, if you cannot attend your appointment with the town hall or decide to cancel for any reason, no refund can be made.

Standard ceremonies at Copenhagen City Hall apply as per the above. When hiring a Private Registrar at Copenhagen City Hall, please refer to the information contained in the sections titled ‘Private Registrar’ and ‘Private Registrar Plus’, below.

As part of our Complete Service and our MayDay Service, if you miss your appointment or need to reschedule, we will be happy to re-book another available date, where there is availability and within the validity period of your approval, without any further fees.

If your validity period has run out and we need to reprocess your application, we would be carrying out the service again and would ask for the usual service fees to be paid.

Private Registrar Service

Under the Private Registrar Service we book a ceremony depending on availability at the Copenhagen City Hall.

 

Pre-Reserved Ceremony – The ceremonies booked depending on the availability of the Copenhagen City Hall can be reserved only after an application has been submitted and are subject to receiving approval fifteen calendar days before the reserved date. The reservation is confirmed after both the approval and the payment for the service is received.

Opting for a ceremony based on availability, there is no refund if you cannot or decide not to make use of the reserved date. You are entitled to change the date to another date provided you request this at least fifteen calendar days before the originally reserved date. This reflects the refund policy the Copenhagen marriage office applies.

 

Booked Ceremony – Private Registrar ceremonies can also be booked depending on the availability at the Copenhagen City Hall and only after approval is received. At that point, any available date can be booked. The reservation offered by the Copenhagen City Hall is confirmed upon payment of the service.

Once booked, there is no refund if you cannot or decide not to make use of the booked date. You are entitled to change the date to another date provided you request this at least fifteen calendar days before the originally booked date. This reflects the refund policy the Copenhagen marriage office applies.

 

Private Registrar Plus Service

Under the Registrar Plus Service, all ceremonies are booked depending on the availability of the Copenhagen City Hall.

 

Pre-Reserved Ceremony – A Registrar Plus ceremony can only be pre-reserved after the application has been submitted and cannot be reserved any less than six weeks prior to the prospective wedding date. The AFL’s approval must be received four weeks before the reserved date or the Copenhagen City Hall will cancel your pre-reservation.

The pre-reservation is confirmed after both the approval and the payment for the service is received.

There is no refund if you cannot or decide not to make use of the reserved date. You are entitled to change the date to another date provided you request this at least three weeks before the originally reserved date. This reflects the refund policy the Copenhagen marriage office applies.

 

Booked Ceremony – A Registrar Plus ceremony can also be booked after approval is received. At that point, any available date can be booked. The reservation offered by the Copenhagen City Hall is confirmed upon payment of the service.

The Copenhagen City Hall is not able to guarantee a personalised speech with less than three weeks notice.

Once booked, there is no refund if you cannot or decide to not make use of the booked date. You are entitled to change the date to another date provided you request this at least four weeks before the originally booked date. This reflects the refund policy the Copenhagen marriage office applies.

 

Bookings and arrangements around your wedding date

GMiD strongly suggest you do not book or reserve anything (flights / accommodation etc) until your approval is received and your wedding date is booked.

GMiD is to no extent liable for any bookings for flights, hotels or any other kind of arrangements made for your trip to and stay in Denmark.

 

Legal entry to Denmark

Legal entry to Denmark is your responsibility. If you lack the right to enter Denmark legally, as a result, for example, of an infringement of the 90/180 rule, you cannot travel to Denmark to get married. The Agency of Family Law will also reject your application in this case.

GMiD has the right to terminate the services if we become aware of overstay in the Schengen Area and/or any infringement of the 90/180 rule after you paid for our Services. Any refunds will be issued in accordance with our cancellation policy.

 

Extra Documentation Requested by the AFL

The AFL may decide extra documentation is required. This cannot always be foreseen by us. We cannot be held accountable for such a request nor for any inconvenience caused by such request.

In these cases, your case will incur delay, which varies depending on the workload of the AFL. We will endeavour to help you to resolve any issues that arise and inform you, to the extent possible, on the time it will take the AFL to issue a final decision.

 

Interview with the AFL

In order, to prevent Pro Forma marriages, the AFL may request for further information or ask you to come for an in-person interview if the submitted information does not allow them to conclude that the sought marriage would be to share your life as a married couple (rather than to aid in obtaining a residence permit).

If we indicate that you may be called in for an interview before your application is made and/or the AFL calls you in for an interview after your application is made and you decide to cancel the procedure, any refunds will be issued in accordance with our cancellation policy.

 

Use of Documents

In line with the GDPR legislation, we delete all your information (emails, messages and documents, etc.) according to our Privacy Policy. Fully anonymised copies of certain documents may be used for training purposes.

 

Force Majeure

In no event shall GMiD be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, illness, acts of war or terrorism, civil or military disturbances, nuclear, epidemics and pandemics or natural catastrophes or ‘acts of God’, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; it being understood that GMiD will use reasonable efforts to resume service as soon as practicable under the circumstances.
